Recognition of Foreign Divorce
An application can be made to the court in Ireland asking the court to decide whether a divorce is entitled to recognition within the State.
Certain foreign divorces granted by another EU member state since the 1st of March 2001 are also entitled to recognition automatically in Ireland under the Brussels II Regulation. This category of foreign divorces is no longer covered by the rules which apply to the recognition of other foreign divorces.
The recognition of foreign divorces that were applied for after the 2nd of October 1986 are governed by The Domicile and Recognition of Foreign Divorces Act, 1986. Divorces applied for prior to that date are governed by a separate set of rules.
As it is often very important to establish whether or not parties are validly divorced this is an area that can lead to very detailed investigation in relation to questions involving what is called habitual residence and domicile.
