Separation Agreement

A separation agreement is a document that is signed by the parties to a marriage setting out the terms of the agreement that they have entered into regarding their separation. There is no court involvement in a separation agreement and it is a binding contract once signed by the parties. It is advisable that both parties provide a sworn document setting out their financial position at the time that the agreement is signed. The reasons for this will be explained in detail at your meeting at this office.

In a separation agreement the parties agree to live separate and apart from each other. The agreement will also deal with a variety of other issues including where relevant maintenance, custody and access of any dependent children, division of property, pensions, taxation issues and succession entitlements following the death of either spouse. Every separation agreement is different and is tailored to the needs of the client, the client’s family and all relevant circumstances.
